By creating an account or using the WorthGenius mobile app, web app, or any related service (collectively, the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Service.
These Terms form a binding contract between you and Binary Data Technology LLC, the operator of WorthGenius ("WorthGenius", "we", "us"). You may also be subject to additional terms that apply when you use specific features (for example, the Stripe billing terms when you subscribe to a paid plan).
You must be at least 13 years old to create a WorthGenius account. Users between 13 and the age of majority in their jurisdiction must have a parent or legal guardian agree to these Terms on their behalf. The Service is not directed to children under 13, and we do not knowingly collect personal data from children under 13.
You may not use the Service if doing so would violate any law in your jurisdiction or any export-control restriction applicable to you.
WorthGenius produces AI-assisted estimates of resale and replacement values for personal property. Estimates are produced from a combination of public marketplace data, image analysis, optical character recognition, and large language model reasoning.
WORTHGENIUS ESTIMATES ARE NOT CERTIFIED APPRAISALS. They are decision-support tools only. Actual market price, replacement cost, and insurance settlement amounts will vary. You agree not to rely on WorthGenius estimates as the sole basis for any insurance claim, purchase decision, sale price, tax filing, or legal proceeding. Where a certified valuation is required, request a paid appraisal through the in-app appraiser marketplace or consult a qualified independent professional.
You are solely responsible for the accuracy of any photos, descriptions, prices, and other content you submit. WorthGenius does not verify ownership, condition, authenticity, provenance, or legality of items you scan.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us at security@worthgenius.com promptly if you believe your account has been compromised.
You agree to provide accurate, current, and complete information when creating your account and to keep that information up to date.
WorthGenius offers a free tier with usage limits, paid subscription plans (Pro, Reseller, Family), and one-time charges for paid appraisals. Payments are processed by Stripe, Inc. and are subject to the Stripe Services Agreement.
Subscriptions auto-renew at the end of each billing period until you cancel. You can cancel at any time from the Settings screen — cancellation takes effect at the end of the current period and you will not be charged again.
Free trials, where offered, automatically convert to a paid subscription unless you cancel before the trial ends.
Refunds are issued at our sole discretion, except where required by law (for example, EU consumers retain their statutory rights). One-time appraisal payments are non-refundable once an appraiser has accepted the request.
We may change subscription pricing at any time on at least thirty (30) days notice; existing subscribers are billed at the new rate at the next renewal.
You agree not to: (a) use the Service for any unlawful purpose; (b) submit photos or descriptions of items you do not have the right to scan; (c) attempt to reverse-engineer, scrape, or overload the Service; (d) circumvent usage limits, paywalls, or rate limits; (e) submit content that is defamatory, infringing, or designed to deceive; (f) impersonate another person or entity; or (g) use the Service to value items that are illegal to possess, sell, or transfer in your jurisdiction.
You retain ownership of the photos, descriptions, receipts, notes, and any other content you submit ("Your Content"). You grant WorthGenius a worldwide, royalty-free, non-exclusive license to host, store, process, transmit, display, and analyze Your Content solely to operate, secure, and improve the Service for you.
We may also use de-identified, aggregated metrics derived from Your Content (for example, "average confidence score across all sneakers scanned in a month") for product analytics and research. We do not sell Your Content.
The Service relies on third-party processors including Google Cloud (hosting, Firebase, Cloud Vision), Anthropic (LLM), OpenAI (LLM), Google AI Studio (LLM), Alibaba Cloud DashScope (LLM, optional), eBay (marketplace data), PriceCharting (collectibles pricing), Veryfi/Mindee (receipt OCR, optional), Stripe (payments), Mailgun (inbound email), Resend (transactional email), Sentry (error tracking), and PostHog (product analytics). Use of those services is governed by their respective terms.
WorthGenius does not control these third parties and is not responsible for their actions or outages. We may add, remove, or replace third-party processors at any time; material changes will be reflected in our Privacy Policy.
The Service, including the WorthGenius name, logo, code, and underlying models, is owned by WorthGenius and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes, subject to these Terms.
If you believe content on the Service infringes your copyright, send a notice meeting the requirements of 17 U.S.C. § 512(c)(3) to dmca@worthgenius.com. We respond to valid takedown notices and will terminate the accounts of repeat infringers.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF VALUATIONS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORTHGENIUS, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU HAVE PAID WORTHGENIUS IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR (b) FIFTY US DOLLARS ($50).
You agree to defend, indemnify, and hold harmless WorthGenius from any claims, damages, liabilities, and expenses (including reasonable attorneys fees) arising out of (a) your use of the Service in violation of these Terms or applicable law, or (b) Your Content.
You may stop using the Service at any time. We may suspend or terminate your access at any time if you violate these Terms, if continued operation creates legal risk for us, or if we discontinue the Service. Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, dispute resolution) survive.
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles.
You and WorthGenius agree that any dispute arising out of or relating to these Terms or the Service that is not resolved through customer support will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. YOU AND WORTHGENIUS WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. You may opt out of arbitration within thirty (30) days of first accepting these Terms by emailing legal@worthgenius.com.
Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual-property or confidentiality rights.
We may modify these Terms from time to time. Material changes will be communicated in-app or by email at least seven (7) days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the modified Terms.
